I hereby agree on this date ___________________________ to breed the Mare, ____________________ __________________________Reg.#_______________, who is a registered (breed) ________________ _____________________mare, age _______ to the Stallion, VR Master Bug, APHA No:00120626 for the __________ breeding season.

1. The stallion fee is $_____________ including a non-refundable booking fee of $500.00 payable with this contract, the balance of which must be paid with all other expenses when any of the conditions below apply:

2. An embryo transfer resulting in more than one mare in foal at thirty days requires an additional stud fee payment for each pregnant mare.

3. Stallion Manager will exercise judgment in care and supervision of mare and/or foal, and the Ranch Veterinarian will examine mare for normal breeding conditions. Stallion Manager and/or the Ranch Veterinarian will administer medical care as deemed necessary for the health and safety of the mare and/or foal. All veterinarian and farrier expenses will be paid by Mare Owner.

4. The mare shall be in a healthy and sound breeding condition, free from infections, contagious or transmissible disease upon arrival at Rockin' M Ranch. A current negative coggins test, no more than 180 days old, photo copy of registration papers (both sides), veterinarian's health certificate, plus a health, worming, and immunization record must accompany mare: if they do not, the Stallion Manager or the Ranch Veterinarian will administer the test and/or vaccines (EWT, Rhino/Flu, Strangles, Rabies and West Nile) at the Mare Owner's expense. Also, a current, negative culture is required on any open mare that is not a maiden, or on any maiden mare that has ever been flushed for an embryo or exposed to a stallion previously. If one does not accompany mare, then the Stallion Manager and/or Farm Veterinarian will do one at Mare Owner's expense.

5. This contract contains a "LIVE FOAL COLOR GUARANTEE". A live foal is described as a newborn which stands and nurses without assistance. If foal is born dead, there are return privileges only IF ROCKIN' M RANCH IS NOTIFIED WITHIN ONE WEEK BY A VETERINARIAN'S STATEMENT CONFIRMING THE DEATH. The live foal guarantee shall be null and void if Mare Owner fails to pay all sums owed. Rockin' M Ranch guarantees that the foal shall have sufficient color to be registered with the APHA. If the breeding results in a breeding stock colt, the mare owner will be entitled to a return privilege with the same mare, or an approved substitute, the following breeding season only. If the breeding results in a solid filly, the mare owner will be entitled to return privileges with the same mare, or an approved substitute, the next breeding season only at one half the breeding fee.

6. Stallion Manager agrees to diligently try to settle Owner's Mare. Mare Owner agrees to give Stallion Manager ample opportunity to settle the mare (having bred her through at least three (3) heat periods). Rockin' M Ranch does not give a Live Foal Guarantee for any mare leaving the farm unless the mare has been pregnancy checked and found to be 30 days in foal by the Ranch Veterinarian. IF MARE LEAVES BEFORE PREGNANCY CHECKED THEN ALL UNPAID BOARD, EXPENSES, AND BREEDING FEE BECOME DUE AND PAYABLE AND THE LIVE FOAL GUARANTEE THEN BECOMES VOID. If, however, for any reason the mare does not settle, Mare Owner will hold Rockin' M Ranch harmless.

7. It is agreed that should the mare miscarry, abort, or prove barren after being pregnancy checked and found to be in foal by the Ranch Veterinarian, the Mare Owner has REBREED PRIVILEGES TO REBREED SAID MARE TO THE STALLION DURING THE IMMEDIATE FOLLOWING YEAR, from the date of this contract. Open mares that are to rebreed to the stallion for a qualified rebreed shall be at ROCKIN' M RANCH ON OR BEFORE MARCH 1, OF THE IMMEDIATE FOLLOWING YEAR.

8. Breeding certificate will be issued only after Mare Owner has notified Rockin' M Ranch that said mare has produced a live foal and all bills have been paid.

9. Both parties agree that ROCKIN'M RANCH, the Stallion Owner, Stallion Manager, and any person associated with ROCKIN' M RANCH is not liable for death, sickness, and/or accident caused to the mare and/or foal; and that Mare Owner is not liable for death, sickness, and/or accident to the Stallion.

10. It is further agreed that should the Stallion die or become unfit for service, any money paid on the stallion fee will be refunded to Mare Owner less the booking fee and any unpaid board and expenses. (ROCKIN'M RANCH, and/or Stallion Manager, and/or Rockin' M Ranch Veterinarian will determine unfitness.)

11. This contract is not transferable or assignable.

12. This contract is entered into in the State of Texas and will be interpreted and enforced under the laws of that State. Venue for any litigation is Austin County.

13. When ROCKIN' M RANCH representative and Mare Owner sign this contract, it will then be binding on both parties, subject to the above terms and conditions.

14. Please indicate type of care desired for mare (and foal). If a choice is not indicated then the Stallion Manager will select accommodations and Mare Owner will be liable for expense.
